TERMS OF SERVICE

Welcome to Mondän & Co Interiors! These Terms of Service (“Terms”) govern the relationship between you (“Client” or “Customer”) and Mondän & Co Interiors (“Mondän & Co,” “we,” “our,” or “us”) regarding the use of our website, app, and interior design services. By accessing our website or app, or purchasing any services, you agree to be bound by these Terms.

We reserve the right to update or modify these Terms at any time. Your continued use of our website, app, or services after changes are posted constitutes acceptance of those changes. Please check this page periodically for updates.


  1. SERVICES OVERVIEW

Mondän & Co Interiors offers three levels of design services:

1.1. Full-Service Interior Design

  • Scope: Comprehensive management of your design project, including space planning, product sourcing, vendor coordination, and design installation.
  • Cancellation Policy: Clients may cancel a Full-Service project mid-way. However:
    • You will be billed for all work completed up to the cancellation date.
    • A 20% cancellation fee will also be charged on the remaining balance of the project.
  • Supplier Returns: We will organize returns for any products purchased through our services, but returns are subject to the return policies of individual suppliers.

 

1.2. Virtual Interior Design

  • Scope: Virtual design services include a customized design plan, furniture layout, and shoppable product links for you to implement independently.
  • Non-Refundable Policy: Fees for Virtual Design Services are non-refundable once design plans and shoppable links have been delivered.
  • Client Responsibilities:
    • Full participation is required to provide room dimensions, photos, and preferences.
    • Clients are responsible for purchasing the recommended products and implementing the design.
  • Stock Limitations: If items go out of stock after designs are delivered, sourcing replacements falls outside the original project scope and may incur additional fees.
  • Revisions: Virtual Design Services include a maximum of two revisions. Any additional revisions will be billed at an hourly rate.


1.3. App-Based Pre-Designed Rooms

  • Scope: Clients purchase ready-made, pre-designed room concepts through our app. Each design includes a furniture layout, product recommendations, and styling tips.
  • Default Layouts: Room designs use standard layouts. Customization to fit your specific dimensions is available at an additional cost.
  • Stock Updates:
    • While we strive to update product links weekly, availability is not guaranteed due to inventory changes by third-party retailers.
    • We recommend implementing designs within three months of purchase to minimize issues related to out-of-stock or discontinued items.
  • Non-Refundable Policy: Pre-designed room purchases are non-refundable once accessed or downloaded, as they are considered delivered at the time of download.
 
  1. GENERAL CONDITIONS
  • You must be at least the age of majority in your jurisdiction to engage with our services.
  • You agree not to misuse our website, app, or services for unlawful purposes, including but not limited to violating intellectual property rights, transmitting malicious code, or engaging in prohibited activities outlined in Section 8 below.
  • We reserve the right to refuse service to anyone at our sole discretion.
 
  1. NON-REFUNDABLE POLICY

All fees for services rendered by Mondän & Co Interiors are non-refundable due to the resources and time committed to delivering your project.


  1. CANCELLATION POLICY
  • Full-Service Design Projects:
    • If a Full-Service project is canceled mid-way, you will be invoiced for all work completed up to the cancellation date, plus a 20% cancellation fee on the remaining balance of the project.
  • Virtual and App-Based Services: Once designs or plans are delivered, cancellations are not permitted.
 
  1. PRODUCT SOURCING AND LIMITATIONS
  • Mondän & Co acts as a design intermediary, sourcing products from third-party retailers. We are not responsible for product availability, changes in pricing, specifications, or retailer policies.
  • While every effort is made to ensure product details and availability are accurate at the time of delivery, we cannot guarantee future availability.
 
  1. CLIENT PARTICIPATION REQUIREMENTS
  • For Virtual Interior Design services, clients must provide accurate room dimensions, photos, and necessary details for the project.
  • Delays in providing information may result in timeline extensions or additional fees.
 
  1. DESIGN IMPLEMENTATION AND LIMITATIONS
  • For Virtual and App-Based Designs, it is the client’s responsibility to implement the design. Mondän & Co Interiors is not liable for issues arising from delays in implementation, incorrect product assembly, or installation errors.
  • Clients are encouraged to implement designs within three months to minimize out-of-stock or discontinued products.
 
  1. LIMITATIONS OF LIABILITY
  • Mondän & Co Interiors is not liable for damages arising from:
    • Delays, discontinued products, or price changes by third-party retailers.
    • Errors in product descriptions or specifications provided by third-party retailers.
    • Incorrect or unsafe installation of recommended products.
  • All services and digital assets are provided “as is” without warranties of any kind, express or implied.
 
  1. INTELLECTUAL PROPERTY

All design plans, layouts, and assets provided remain the intellectual property of Mondän & Co Interiors. Use of these materials is granted for personal, non-commercial purposes only.


  1. RETURNS AND PRODUCT GUARANTEES
  • Full-Service Clients: Returns of products sourced as part of a Full-Service project will be handled according to the supplier’s return policies. Mondän & Co Interiors will facilitate returns when possible.
  • Virtual and App-Based Services: Mondän & Co Interiors does not manage returns or warranties for products purchased through shoppable links or app-based recommendations. Clients must handle returns directly with the retailer.
 
  1. FORCE MAJEURE

Mondän & Co Interiors shall not be held liable for any delays or failure to perform resulting from causes beyond our reasonable control, including but not limited to acts of God, pandemics, supplier disruptions, or other unforeseen events.


  1. PROHIBITED USES

You agree not to misuse our website, app, or services in any way, including but not limited to:

  • Engaging in illegal activity.
  • Violating intellectual property rights.
  • Transmitting malicious code or engaging in cyberattacks.
